SHIVAG: New Prosecution Policy on International or Reckless Transmission of, or Exposure to, Sexually Transmitted Infections

The COPFS prosecution policy for cases involving the intentional or reckless transmission of, or exposure to, sexual infection has been published today on the COPFS internet site. The policy aims to provide guidance to prosecutors but also provide clarity and consistency to the public in general about this area of the law

This guidance sets out how prosecutors should deal with cases involving an allegation of intentional or reckless sexual transmission of, or exposure to, infection which has serious, potentially life threatening consequences for the person infected. In developing this guidance, the Crown Office and Procurator Fiscal Service (COPFS) has consulted with the public health sector and has benefited substantially from their input and expertise.

Their advice has been greatly appreciated, however, the content of this policy statement remains the responsibility of the COPFS. There have been very few prosecutions in Scotland involving intentional or reckless transmission of, or exposure to, sexually transmitted infection. Although previous prosecutions have involved HIV infection, this policy is not restricted to HIV and applies to any sexual infection which could have serious, potentially life threatening consequences for the person infected.

Annex A provides details of previous prosecutions. The prosecution of Mark Deveraux in 2010, for the culpable and reckless transmission of, and exposure to, the Human Immunodeficiency Virus (HIV) attracted some concern from the public health and HIV sector due to the prosecution of charges where there was no transmission of the infection to the victim. One concern was that the threat of prosecution, particularly in circumstances where no resultant infection occurs, could prevent people at risk from sexually transmitted infection coming forward for testing.

Invitation to all NHS Counsellors and psychotherapists to participate in a research project:

If you are a counsellor or psychotherapist working in the NHS I would really value your input into this research in order to document therapists understanding and experience of clinical governance. This should only take about 5 to 10 minutes of your time.

I am undertaking research in the field of clinical governance. Clinical Governance is the system through which NHS organisations are accountable for continuously monitoring and improving the quality of their care and services and safeguarding high standards of care and services.

This may provoke a range of reactions in the autonomous practitioner (like you may feel you are being told what to do) where there is an expectation that we work within a quality framework like clinical governance.

The purpose of this investigation is to measure NHS counsellors and psychotherapists understanding and experience of clinical governance within the NHS.

If you are interested then please click to this link (https://www.surveymonkey.com/s/toshlynchresearch) which will provide you with further information and a questionnaire.

Where members pensionable pay falls as a consequence of the withdrawal of nationally agreed Recruitment and Retention Premia, arrangements have been put in hand to ensure that the impact on final pension is limited by pay protection. This should be arranged between employers and NHS Pensions without members having to do anything.

As currently planned, under the transitional arrangements, payments of the national RRP will stop on 31 March 2013 when the 50% payment ceases. NHS pensions taking account of the three year basis of assessment of final pay consider that protection does not need to be put in place until 2013. At that time employers are under instruction to notify all cases to NHS Pensions and to write to all affected members telling them protection has been put in place.

Under protection members pensions are calculated in two parts based on pension up to 2013 and pension after 2013 and that is compared with a standard pension calculation based on all service, with the member getting the higher of the two. The benefits of protection are structured so as to retain their value after any changes to the pension scheme as may be implemented in 2015 or any transfer by members between the 1995 and 2008 sections as a result of their Choice decision.
